§ 1

Caritas of the Zamojsko-Lubaczowska Diocese with its seat in Zamość, ul. Zamoyskiego 1, 22-400 Zamość, KRS: 0000350686, NIP: 9221899334 runs the Website under the domain caritas.zamojskolubaczowska.pl, hereinafter referred to as the Website in accordance with these Regulations and the Privacy Policy.
The website works to implement and support the statutory activities of Caritas of the Zamość – Lubaczów Diocese, among others, to obtain donations for organizing emergency and development aid in Poland and abroad.
Acquiring donations is part of the charitable and caring statutory activities of Caritas of the Zamość – Lubaczów Diocese.
Revenues from donations received with indication of the purpose constitute revenues from charitable and caring statutory activities of Caritas of the Zamość – Lubaczów Diocese.
The Regulations for payments by the Website, hereinafter referred to as the Regulations, define the principles and conditions of its functioning, including the rights and obligations of Users, Donors, Partners and the Operator.
The Regulations also define the scope of the Operator’s liability.

 

§ 2

The wording used in the Regulations should be understood as follows:

Purpose – an action announced on the Website consisting in the collection of funds for the implementation of a specific socially useful purpose, included in the charitable and caring statutory activity of the Operator, proposed by Caritas of the Zamojsko-Lubaczowska Diocese or Partners;
Donor – any legal entity, including a natural person, legal person or organizational unit without legal personality, which has made at least one payment in any form for the purpose indicated on the Website in accordance with the provisions of these Regulations;
Donation – donation within the meaning of the common law, in particular the Civil Code, constituting an amount of money voluntarily donated by the Donor to the charity and care statutory activity of the Operator without indicating or indicating the Purpose described on the Website, without making anyone a creditor;
Operator – Caritas of the Zamojsko-Lubaczowska Diocese based in Zamość, ul. Zamoyskiego 1, 22-400 Zamość (KRS: 0000350686, NIP: 9221899334), which runs the website;
Partners – entities submitting proposals for Objectives to be financed by the Donors on the Website;
Financial Brokerage Service – a financial brokerage service run as part of the DotPay service by PayPro SA, ul. Kanclerska 15, 60-327 Poznań, making it easier for Donors to make Donations;
User – any legal entity, including natural persons, legal persons or organizational units without legal personality, including Donors, who use the Website in any way.

 

§ 3

The sole owner of the Website is the Operator.
Before using the Website, each User should read the provisions of the Regulations and the Privacy Policy.
Each User using the Website unconditionally accepts the provisions of the Regulations and the Privacy Policy in full.
The use of the Website, even in part, for any purpose without the consent of the Operator is prohibited.

 

§ 4

Using the Website may not violate generally applicable law and the provisions of the Regulations and the Privacy Policy.
For the proper use of the Website, each User should have technical devices with Internet access along with legal software, including web browsers.
Users making payments for the indicated Purposes through the financial intermediation service should have an active personal e-mail (e-mail) or provide their address of residence in order to send any acknowledgments or information about the project.

 

§ 5

The Operator enables the Partners to submit proposals of Goals.

 

§ 6

Using the website is completely voluntary and free of charge.
The Operator enables Users to make one-off Donations for Purposes by voluntarily selecting via the financial intermediation website or by posting information on the target account number of Caritas Polska on the Website.

§ 7

The goals on the Website are announced independently by the Operator as part of the statutory activities of Caritas of the Zamość – Lubaczów Diocese.
When submitting a proposal for a Purpose to the Operator, the Partner should specify in particular:
goal of the action
the proposed value of cash, the collection of which is necessary to achieve the Goal.
Users can make a one-time Donation according to their choice by paying the amount to the Operator’s account via the financial intermediation website, or a one-time Donation via bank websites (internet transfers) or traditional transfers and direct debits (banks, post office).
The User may view the list of available payment methods after switching from the payment form available on the Operator’s Website to the Financial Intermediation Service. In the event of disagreement to use the available payment channels, the User may resign from making the payment. Before making the payment, the user is informed about the purpose of the donation and the form in which it can be provided in the information provided next to the payment form.

The operator informs that in the case of payment via the financial intermediation website, a commission is collected by the financial intermediation website for the financial intermediation website, in accordance with the terms of the contract concluded between PayPro S.A. and the Operator. Also, settlements of transactions related to the transfer of Donations made with a credit card are carried out through the financial intermediation service, which charges a commission, in accordance with the terms of the contract concluded between PayPro S.A. and the Operator. The operator does not earn any income from the commission being charged by the financial intermediation service. The amount of the commission is confidential resulting from the contract concluded between PayPro S.A. and the Operator. The purpose of the functioning of the financial intermediation website is to make it as easy as possible for Users to make the payments in question. If the other forms of payment are chosen voluntarily, no commission is charged by the Operator.
In the event of a possible donation by the Operator to the Partner for the implementation of the Purpose, he is obliged, within the time indicated by the Operator and at his request, to provide the Operator with a detailed settlement regarding the manner of spending by the Partner funds from the action constituting the Purpose, as well as other information, which in the report, the Operator will request.
If, for reasons beyond the Operator’s control, during the duration of the Purpose campaign becomes pointless or the amount necessary to implement the Purpose through the Website or other sources of financing has not been obtained, the Operator may allocate the collected amount entirely to the implementation of statutory objectives, in particular for a goal similar to the goal of the action constituting the Goal. In addition, the collection for a specific Purpose may be repeated until the amount necessary to achieve the Purpose is obtained, if the Operator determines that there is a real probability of achieving the Purpose.
The surplus of the collected amount may be allocated to other charitable and protective statutory goals of the Operator.
The Operator declares that the funds transferred to the Caritas account of the Zamojsko-Lubaczowska Diocese by the Users constitute a donation of the User for the purposes indicated on the Website, which are included in the statutory activity of the Operator.
Payment of a donation does not make anyone a creditor, in particular towards the Operator.

 

§ 8

The operator may collect funds only for the maintenance of the Website and for the costs of servicing the project, which may not exceed 12% of the funds collected. The operator cannot obtain any profit from the functioning of the Website.

 

§ 9

By accepting the Regulations or using the Website, the User agrees to the processing of his personal data by the Operator in accordance with the terms of these Regulations and the principles set out in the Privacy Policy, which is an integral part thereof.
The administrator of personal data is the Website Operator who processes Users’ personal data in accordance with the generally applicable provisions of law.
The Operator processes Users ‘personal data in accordance with the privacy policy only for the proper use of the Website by electronic means, including donations and the possibility of sending a possible Newsletter to the Users’ e-mail address. The processing of personal data for purposes other than those specified above is possible only after the User expresses his consent to the processing of personal data for the purposes expressly indicated by the Operator.
The User has the right to access the processed personal data at any time, as well as the right to correct them and demand their removal in accordance with generally applicable provisions of law.
The operator informs that:
Caritas Diecezja Zamojsko-Lubaczowskiej as the administrator of personal data processes Users’ personal data.
Caritas of the Zamojsko-Lubaczowska Diocese with headquarters in Zamość at ul. Zamoyskiego 1, is the administrator of Users’ personal data: name, surname, email, telephone number, address, donation amount and the purpose of the donation.
The administrator has appointed a Data Protection Officer, whom you can contact in writing to the following address: Caritas Diocese Zamojsko – Lubaczowskiej with headquarters in Zamość, ul. Zamoyskiego 1 or electronically in the form of [email protected]
The basis for the processing of Users’ personal data is consent to the processing of personal data or a donation agreement as well as the legitimate purpose of the administrator. We process your data in order to enable the use of the Website and possible donation.
The operator will process Users’ personal data in the form of first name, surname, email address, telephone number, address, donation amount and the purpose of the donation.
Users’ personal data may be made available to the following recipients:
administrator’s staff;
at the same time, Users’ personal data may be transferred to external law offices supporting the administrator.
Caritas of the Zamojsko-Lubaczowska Diocese will not transfer Users’ personal data to third countries or international organizations.
Users’ personal data will be stored appropriately for the period required by the relevant provisions regarding the storage of documentation regarding the internship and the period of limitation of possible claims of Users against the administrator.
Users are entitled to:
the right to request the administrator to access the User’s personal data;
the right to rectify the User’s personal data;
the right to delete the User’s personal data;
the right to limit the processing of the User’s personal data;
the right to object to the processing of the User’s personal data;
the right to transfer the User’s personal data;
the right to withdraw consent to the processing of personal data of the User, if this consent was the sole basis for the processing of personal data;
the right to lodge a complaint with the supervisory body in the form of the President of the Personal Data Protection Office.
Providing personal data is voluntary, however, failure to provide them makes it impossible to use the Website.
Caritas Polska will make automated decisions in the field of Users, including in the field of profiling Users’ personal data.
The operator may request the User to immediately remove untrue personal data or update them, or possibly block the User from accessing the Website.
The Operator may disclose Users’ personal data only to entities authorized under the relevant provisions of generally applicable law or to other entities that cooperate with the Operator in the functioning of the Website in order to achieve the Purpose.

§ 10

Contractual or tort liability of the Operator towards Users, Partners or third parties for their damage or harm that may arise due to:
a) technical problems of the Website or its updates;
b) loss of data resulting from force majeure or updating the Website;
c) actions of Users, Partners or third parties contrary to the law or the Regulations or the Privacy Policy.
The Operator’s contractual or tort liability for any obligations of Partners as well as Users or third parties is excluded.
The Operator may enable Users to access services provided by third parties via the Website. In this case, the Operator does not bear any responsibility for the actions or omissions of third parties.
Each User is fully liable for any damage or harm resulting from the use of the Website in a manner inconsistent with generally applicable law or the provisions of the Regulations or the Privacy Policy, in particular by infringing personal rights as well as copyrights and related rights.

 

§ 11

The User may submit a complaint in matters related to the functioning of the Website by e-mail to the Operator’s e-mail address: [email protected] or in writing to the address of the Operator’s registered office.
A response to a properly submitted complaint should be given by the Operator within 14 days in electronic form or in writing to the User’s address known to the Operator.
Complaints in matters related to the functioning of the financial intermediation service are considered by the financial intermediation service on the basis of its separate regulations independent of the operator.

 

§ 12

The operator may at any time change the Regulations with a minimum seven-day period of entry into force.
The Regulations apply from the date of their publication on the website after prior written approval of the Director of Caritas of the Zamość – Lubaczów Diocese.
In matters not covered by the Regulations, the provisions of generally applicable law shall apply, including the Civil Code and the Personal Data Protection Act, as well as the relevant provisions of canon law.
In the event that any of the provisions of these regulations are invalid or ineffective, it does not make the remaining provisions of these regulations invalid or ineffective.
The court having jurisdiction over all disputes related to the functioning of the Website is the court having jurisdiction over the seat of the Operator.
